Terms of Use and Privacy Policy for the E-Learning Platform of Al-Ahgaff University
Definitions
For the purposes of this document, the following terms and expressions shall have the meanings indicated beside each, unless the context indicates otherwise:
- University: Al-Ahgaff University.
- Platform: The University’s Distance Learning Platform.
- User: Any student, faculty member, staff member, or authorized individual using the Platform.
- Educational Content: All materials and resources published on the Platform, including lectures, presentations, exams, interactive activities, and any other materials.
Acceptance of Terms
By accessing or using the Platform, the User acknowledges that they have read, understood, and agreed to be bound by these Terms. Such acceptance is mandatory for entry into the Platform and use of its services.
Intellectual Property Rights
- All rights related to educational content, software, digital systems, designs, logos, and trademarks displayed on the Platform are protected under intellectual property laws and applicable national and international regulations.

The University is the sole owner or licensed user of all digital content and materials available on the Platform, including but not limited to:
- Text, visual, and audio content.
- Lecture slides and presentations.
- Exams and interactive activities.
- Audio and video recordings.
- Embedded databases within the Platform.
- Software code and API interfaces.

Users are strictly prohibited from engaging in the following actions unless prior written permission is obtained from the University:
- Copying, republishing, or redistributing any part of the educational content or digital materials by any means or format.
- Downloading or recording lectures or interactive activities for personal storage or external sharing.
- Creating derivative, modified, or translated works from the original content.
- Using the University's trademarks, logos, or trade names in any advertisement, publication, or other activities.
- Leasing, selling, or transferring any access rights to the Platform or its content.
- Under no circumstances may educational content be used for purposes other than academic and personal study within the University. Any use for commercial, promotional, or external training purposes is strictly prohibited.

The University reserves full rights to pursue legal or administrative actions against any misuse, including but not limited to:
- Suspending or terminating the violator’s account.
- Seeking financial compensation for any damages or losses resulting from intellectual property infringement.
- Filing legal claims with competent authorities to secure full legal rights.
- Granting access to the Platform or its content shall not be construed as a waiver of intellectual property rights or an implicit license to use the materials beyond the permitted scope.
Privacy and Data Protection
- The University is committed to taking all necessary measures to protect the confidentiality of user data.

Data collected during registration and usage includes:
- Basic Data: Name, student ID, faculty, email address.
- Usage Data: Access time and date, materials used, educational activities.
- Technical Data: IP address, device and browser type.
- The University shall not share user data with any third party unless required by law or with the user’s explicit consent.
- Users have the right to request access to or correction of their personal data by contacting the Platform administration.
User Conduct and Responsibilities
- Users must use the Platform exclusively for academic and educational purposes.

The following actions are strictly prohibited:
- Any activity that may harm, disrupt, or attempt to bypass the Platform’s systems.
- Misuse of content or publication of material contrary to public decency or the law.
- Impersonating another user or any official entity.
- Users are fully responsible for all activities conducted through their personal accounts.
University Rights and Authority

The University retains full rights and authority over Platform management and may take any technical or administrative measures to protect content and maintain service quality. These include but are not limited to:
- Monitoring user activity to ensure compliance with this document and University policies.
- Maintaining logs and reports of platform activity and behavior.
- Restricting, blocking, or terminating access to the Platform, in whole or in part, in cases of suspected misuse.
- Implementing any technical measures to address breaches or system disruptions.

The University may suspend or terminate a user’s account without prior notice under the following circumstances:
- Violation of any provision in this document or University policy.
- Misuse of content or digital tools provided on the Platform.
- Endangering Platform security or the rights of other users.
- Any conduct that negatively impacts the University's reputation or service quality.
- The University reserves the right to amend, update, or revise this document or any related supplemental policies at any time as deemed necessary, with changes taking effect upon publication on the Platform or through official University email notifications.
- Users bear full responsibility for reviewing such updates regularly, and continued use of the Platform constitutes explicit acceptance of any modifications.
- The University may perform scheduled or emergency maintenance or upgrades to the Platform, which may result in temporary service interruptions. The University will endeavor to provide advance notice where possible and is not liable for any damages or data loss resulting from such interruptions.
- The University has the right to take any actions it deems necessary to protect its legal and institutional interests in the event of a breach, including disciplinary action or escalation to legal authorities.
Disclaimer of Liability

The University strives to ensure the Platform operates efficiently and reliably and is free of defects. However, users acknowledge that Platform services are provided “as is” and “as available” without express or implied warranties, including but not limited to:
- Continuous, error-free service.
- Suitability of the Platform for purposes beyond academic use.
- Accuracy, completeness, or reliability of content or data displayed.

The University is not liable for any direct, indirect, incidental, or consequential damages resulting from:
- Use of or inability to use the Platform for any reason.
- Reliance on posted information without verification of its accuracy or appropriateness.
- Technical faults, emergency maintenance, or necessary updates.
- Malware or viruses despite the application of cybersecurity protocols.
- Users are fully responsible for safeguarding their login credentials (username and password) and acknowledge full liability for any activity conducted through their account.
- The University is not responsible for any content published or uploaded by users on the Platform and reserves the right to remove any content it deems in violation of policies, laws, or public morals without prior notice.
- Users acknowledge that the University may modify, suspend, or permanently discontinue the Platform or any part of it at any time without prior notice and without compensation.
- Users are responsible for verifying the accuracy and currency of any educational materials, particularly when used in research or for external academic purposes.
Rights Protection and Dispute Resolution
- This document and all matters related to Platform use or interpretation of these terms are governed by the laws and regulations in force in the Republic of Yemen, without prejudice to applicable international agreements to which Yemen is a party.
- All users are obligated to respect and preserve the University’s intellectual and financial rights related to the Platform. Any breach may result in legal liability and compensation.
- In case of any dispute regarding the interpretation or application of this document, both parties must first make every effort to resolve the issue amicably through direct communication or administrative mediation by the Platform administration.
- If no amicable solution is reached within thirty (30) days of initiating such efforts, either party may refer the dispute to the University’s arbitration center or competent courts in the Republic of Yemen.
- Resorting to legal or administrative action by the University shall not be construed as a waiver of any other rights or remedies available under applicable laws.
- The University retains the right to impose internal disciplinary measures, including suspension or cancellation of the offending user’s account, in addition to the right to seek compensation for any resulting damages.
- Users must fully cooperate with the University during any investigation or review of violations or disputes related to this document, including providing necessary data and information to support inquiries.
